Rubbish Removal Soho Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Soho provides waste and rubbish collection services. By making a booking, using our services or allowing us access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, organisation or other party requesting or receiving rubbish removal or waste collection services from us.

Services means any rubbish removal, waste collection, bulky waste clearance, recycling, loading, transportation, and associated activities that we agree to provide.

Waste means any items, materials or substances that the Customer asks us to collect and remove, provided that such items are acceptable under these Terms and applicable waste regulations.

Agreement means the contract between Rubbish Removal Soho and the Customer, formed when a booking is accepted by us.

2. Scope of Services

We provide rubbish removal and waste collection services for domestic and commercial customers. Our services may include one-off clearances, scheduled collections, and ad hoc waste removal as agreed at the time of booking.

Services are provided only for the collection of waste that the Customer is lawfully entitled to dispose of and that we are authorised and able to collect and transport in compliance with applicable laws and regulations.

We reserve the right to refuse to remove any waste that we reasonably consider unsafe, unlawful, hazardous, inadequately described, not accessible, or beyond the originally agreed volume or type.

3. Booking Process

3.1 Bookings can be made by telephone, email, online enquiry or other communication channels we may specify from time to time. The Customer must provide accurate information about the type, approximate volume and location of the waste to be collected.

3.2 A booking is not confirmed until we have accepted it and communicated a booking confirmation, which may include the estimated price, the collection date and time window, and any specific conditions.

3.3 All time slots are estimates and subject to traffic, access, weather and operational constraints. We will use reasonable efforts to attend within the agreed arrival window, but timing is not guaranteed and is not of the essence of the Agreement.

3.4 The Customer must ensure that an authorised person is present at the premises at the agreed time to provide access, confirm the waste to be removed, and approve any updated quotation if changes are required.

4. Estimates, Quotations and Price Adjustments

4.1 Any price provided prior to our arrival is an estimate only, based on the information supplied by the Customer. The final price will be confirmed on site once our team has inspected the waste, assessed access and evaluated the actual volume, weight and nature of the materials.

4.2 If the actual waste differs from the description or photos supplied at the time of booking, or if access is more difficult than reasonably anticipated, we may revise the price to reflect the additional time, labour, equipment, disposal fees or specialist handling required.

4.3 If the revised price is not acceptable to the Customer, the Customer may decline the service before work begins. In such circumstances, we reserve the right to charge a call-out, attendance or cancellation fee to cover our costs, as explained at the time of booking.

5. Payments and Charges

5.1 Unless we agree otherwise in writing, payment is due in full at the time the service is completed and before our team leaves the site. For some bookings, part or full payment may be required in advance.

5.2 We accept payment methods as notified from time to time, which may include cash, card payments, bank transfer or other methods. The accepted methods may vary depending on the type of service or booking channel.

5.3 All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes or charges, which will be made clear at or before the time of booking where applicable.

5.4 If payment terms other than immediate payment are agreed, invoices must be paid within the period stated on the invoice. We reserve the right to charge interest on overdue amounts at the maximum rate permitted under applicable law, together with any reasonable costs incurred in recovering the debt.

5.5 Where waste volumes, labour requirements or disposal costs exceed the level originally anticipated, supplementary charges may apply. These will be explained on site before additional costs are incurred wherever reasonably possible.

6. Cancellations, Rescheduling and Access

6.1 The Customer may cancel or reschedule a booking by providing reasonable advance notice. Where possible, we request at least 24 hours notice prior to the scheduled arrival time for standard bookings.

6.2 If the Customer cancels within a shorter timeframe, or fails to provide access at the appointed time, we reserve the right to charge a cancellation or wasted journey fee to cover our costs, including labour, transport and lost booking opportunity.

6.3 If our team is unable to gain safe and reasonable access to the premises or to the waste to be removed, or if access requires permissions not disclosed in advance, we may treat the visit as a same-day cancellation and apply appropriate charges.

6.4 We may cancel or reschedule a booking if circumstances arise beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents or legal restrictions. In such cases, our liability is limited to rescheduling the service or refunding any amounts paid in advance for the affected booking.

7. Customer Obligations

7.1 The Customer must ensure that we have safe and reasonable access to the premises and the waste to be collected, including any necessary parking arrangements, entry codes, permissions or permits.

7.2 The Customer must provide accurate and complete information about the waste, including any hazardous, sharp, heavy or awkward items, and advise us of any potential risks on the premises such as fragile surfaces, low ceilings, restricted staircases or uneven floors.

7.3 The Customer is responsible for obtaining any consents required from landlords, neighbours, building managers or local authorities to allow access, loading and unloading, and short-term parking where relevant.

7.4 The Customer must remove or secure any valuable, delicate or fragile items that could be damaged during the course of our work and must highlight any particular areas of concern to our team before work begins.

8. Waste Types and Regulations

8.1 We operate in accordance with relevant UK waste legislation and regulations. We are committed to responsible rubbish removal, recycling and waste management, and we only use licensed and authorised disposal, recycling and transfer facilities.

8.2 Certain types of waste cannot be collected under our standard service, including but not limited to: clinical or medical waste, certain hazardous chemicals, gases, explosives, asbestos and materials that require specialist licences or treatment. If in doubt, the Customer should ask us in advance.

8.3 We reserve the right to refuse any waste that appears to be hazardous or prohibited, or to apply additional charges where specialist handling, packaging, transportation or disposal is required.

8.4 Ownership of the waste transfers to us only once payment is received and the waste has been loaded onto our vehicle. Once collected, we will manage the waste in accordance with legal requirements and our environmental policies.

9. Exclusions and Limitations of Liability

9.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

9.2 Subject to clause 9.1, our total liability arising under or in connection with the Agreement, whether in contract, tort including negligence, breach of statutory duty or otherwise, is limited to the total price paid or payable by the Customer for the specific service giving rise to the claim.

9.3 We are not liable for any indirect or consequential losses, including but not limited to loss of profit, business interruption, loss of anticipated savings, loss of opportunity or any similar or related losses.

9.4 While our team will take reasonable care when carrying out rubbish removal and waste collection, the Customer acknowledges that minor scuffs, marks or wear may occur when moving bulky items in confined spaces. We are not liable for cosmetic or pre-existing damage, or for damage where the Customer has requested that we proceed despite our reasonable concerns about access or safety.

9.5 The Customer is responsible for ensuring that items intended to be kept are clearly separated from waste. We are not liable for any loss of items that were not clearly identified as items to be retained, or that were left in or attached to waste being removed.

10. Insurance

10.1 We maintain appropriate insurance cover as required for the nature of our waste collection and rubbish removal services. Details of our insurance can be provided upon reasonable request.

10.2 The existence of insurance does not extend or increase our liability beyond that set out in these Terms and Conditions.

11. Health and Safety

11.1 We will operate in accordance with applicable health and safety laws and good industry practice. Our team may refuse to undertake work that, in their reasonable opinion, presents an unacceptable risk to health, safety or property.

11.2 The Customer must notify us of any known hazards or risks within the premises or associated with the waste to be removed. This includes, for example, structural defects, loose flooring, exposed wiring or the presence of hazardous substances.

12. Complaints

12.1 If the Customer is dissatisfied with any aspect of our service, they should contact us as soon as reasonably possible, providing details of the concern, the date of service and any relevant booking reference.

12.2 We will investigate complaints in good faith and aim to respond within a reasonable time. Where we are at fault, we may, at our discretion, offer a remedy such as a partial refund, a re-visit or another appropriate solution.

13. Data Protection and Privacy

13.1 We collect and use personal information as necessary to process bookings, deliver services and manage our business, in accordance with applicable data protection laws.

13.2 The Customer is responsible for ensuring that any personal data provided to us about third parties is supplied lawfully and with appropriate consent where required.

14. Variation of Terms

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that booking.

14.2 Any changes to the Services, prices or specific terms relating to a particular booking will be confirmed to the Customer at or before the time of booking or as otherwise agreed in writing.

15. Severability

15.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, it shall be deemed deleted, but that shall not affect the validity or enforceability of the remaining provisions.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.

17. Third Parties

17.1 A person who is not a party to the Agreement shall not have any rights to enforce any term of it under the Contracts Rights of Third Parties Act 1999 or otherwise.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation including non-contractual disputes or claims shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Agreement or their subject matter or formation.

By using the rubbish removal and waste collection services of Rubbish Removal Soho, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
